Definition:
Residential Buildings with Units for Freehold, Leasehold, Commonhold

Residential Buildings with Units for Freehold, Leasehold, Commonhold are residential buildings, which consist of units for which there is a entry for "part ownership of non-habitable rooms" (Sondereigentum nach den Vorschriften des Wohnungseigentumsgesetzes) in the land register for commonhold flats.

According to the German Condominium Act a residential building is either consisting only of units for freehold, leasehold or commonhold or there is no such unit at all.

Decisive is the proposition of the developer at the time of the application for a planning permission to sell individual units as freehold, leasehold or commonhold. Even if the developer intents to let some or all of the units, which are registered as condominiums, the building is regarded as "Building with Units for Freehold, Leasehold, Commonhold".
